Privacy Policy
Overview
AI Berg Studio (“we”, “us”) takes data protection seriously. This privacy policy explains what data we collect when you use our website and how we process it, in accordance with the General Data Protection Regulation (GDPR) and German data protection law (BDSG).

What data we collect
When you use this website, we may process:
- Company name and description you provide during the assessment
- Industry, role, and process selections you choose
- Free-text responses you type into the assessment (for example, when you describe a pain point)
- Your email address, only if you choose to receive your results, send a message through the contact form, or write to us directly
- Anonymous usage analytics (only if you accept analytics cookies)
We do not ask for, or intentionally collect, any special-category personal data (for example, health data, political opinions, or religious beliefs). Please do not enter such data into the assessment.
How we process your data
- AI analysis (Anthropic Claude): The company name, description, role, process selections, and free-text responses you enter into the assessment are sent to Anthropic's Claude API to generate a personalised AI opportunity assessment. Your email address is never sent to Claude. Anthropic processes this data as our processor under their data processing agreement and does not use it for model training.
- Web research (Perplexity): Your company name and description are sent to the Perplexity API to look up publicly available information about your company. No personal data (name, email, role) is sent to Perplexity.
- Email delivery (Resend): If you choose to receive your results by email, submit the contact form, or send a message through the assessment, we use Resend to deliver that email. Resend processes your email address and the message content as our processor.
- Copy to AI Berg Studio: When you ask us to email you your assessment results, a blind carbon copy (BCC) is also sent to Nina Kiwit at AI Berg Studio so she can follow up with you personally. This is disclosed at the point you enter your email address, and is the reason you are giving consent. If you do not want us to receive a copy, please do not use the “Email me my results” field.
- Session follow-up (with explicit consent only): If you accept the cookie banner, a summary of your completed assessment (company, role, selections, generated opportunities) is emailed to Nina Kiwit so she can prepare a personalised follow-up. If you decline the cookie banner, nothing is saved beyond your current browser session.
- Analytics (PostHog): If, and only if, you accept the cookie banner, we load PostHog for anonymous product analytics. PostHog helps us understand which parts of the site are confusing or broken. Analytics are fully disabled until you opt in and can be disabled again at any time via the “Manage cookies” link.
International data transfers
Some of our processors are located in the United States: Anthropic (Claude API), PostHog (US instance), and Vercel (website hosting). Transfers of personal data to these processors are covered by the European Commission's Standard Contractual Clauses (SCCs) and, where applicable, the EU-US Data Privacy Framework. Resend is operated from the EU region. Perplexity is located in the United States and only receives your company name and description, not your email or other personal data.
Legal basis
- Consent (Art. 6(1)(a) GDPR) for the assessment, for storing your session, for emailing you your results with a copy to Nina, and for product analytics.
- Pre-contractual measures and legitimate interest (Art. 6(1)(b) and (f) GDPR) for processing contact form submissions and follow-up correspondence about a potential engagement.
Data retention
Assessment session data sent to Nina is retained in her inbox for up to 12 months, unless you request earlier deletion. Contact form submissions and email correspondence are retained for the duration of the business relationship and for as long as required by applicable tax and commercial law afterwards. Analytics data (if you consented) is retained for up to 12 months. You can request deletion of any of the above at any time.
Your rights
Under GDPR, you have the right to:
- Access your personal data (Art. 15)
- Rectification of inaccurate data (Art. 16)
- Erasure of your data, the “right to be forgotten” (Art. 17)
- Restriction of processing (Art. 18)
- Data portability (Art. 20)
- Object to processing (Art. 21)
- Withdraw consent at any time, without affecting the lawfulness of processing before withdrawal (Art. 7(3))
- Lodge a complaint with a supervisory authority. For Berlin, this is the Berliner Beauftragte für Datenschutz und Informationsfreiheit (mailbox@datenschutz-berlin.de)
